If you do not agree with these Terms, you must not use Artoria.

2. About Artoria
Artoria is a private digital platform dedicated to art and culture and intended for members of Artoria Society.
Access to member-only Artoria services is available to individuals who have been admitted to Artoria Society and hold an active paid membership.
Artoria may combine cultural and educational content, art discovery, digital tools and features intended for the Artoria Society community.
The service may include, among other things:
- cultural, educational and editorial content;
- information about artists, artworks, artistic movements, periods, museums and related subjects;
- quizzes and interactive activities;
- tools for saving progress, favourites and collections;
- visual identification or analysis features;
- maps and geographical information;
- automated search, classification, recommendation or identification features;
- features and services intended for Artoria Society members;
- private member profiles or community features, where available;
- invitations, information or access relating to selected events and experiences;
- digital membership credentials and related membership services.
Available features and benefits may vary according to the membership offered, app version, device, operating system, region, availability and other technical or operational conditions.
Artoria may develop, replace or discontinue individual features over time in accordance with these Terms and applicable law.
3. Minimum Age and Eligibility
Artoria is intended exclusively for persons aged 18 or over.
By creating an account, submitting an application, accepting an invitation or using Artoria, you represent that you are at least 18 years old.
We may suspend or close an account if we have reasonable grounds to believe that this requirement is not met.
Admission to Artoria Society is subject to the membership process described in these Terms.
4. User Account
An account may be required to apply for Artoria Society, accept an invitation, purchase a membership and use Artoria.
You are responsible for:
- providing accurate and reasonably up-to-date information;
- maintaining the confidentiality of your login credentials;
- maintaining reasonable security over the device through which you access Artoria;
- activity carried out through your account to the extent that it is under your control.
You must not knowingly allow an unauthorised person to use your account.
If you suspect unauthorised access to your account, you should contact us within a reasonable time and use the security measures available to you.
To the extent permitted by law, we are not responsible for losses caused exclusively by your voluntary disclosure of login credentials, failure to take reasonable measures to protect your own device, or circumstances otherwise outside Artoria’s reasonable control.
5. Artoria Society Membership
5.1. Membership requirement
Artoria Society is a paid private membership service.
Artoria does not offer a general free membership tier.
Creating an account, submitting an application or receiving an invitation does not in itself grant active membership.
To obtain access to the services and benefits reserved for Artoria Society members, a person must:
- be admitted through the standard application process or through a valid member invitation; and
- successfully purchase and maintain an active membership.
5.2. Standard application
A person may apply to join Artoria Society through the Artoria application.
The application may request information reasonably required to assess the application, including information described in the Privacy Policy.
Submitting an application:
- is free of charge unless expressly stated otherwise before submission;
- does not constitute the purchase of a membership;
- does not create an obligation to pay;
- does not guarantee admission to Artoria Society;
- does not, by itself, give access to member-only features or benefits.
5.3. Application review
Standard applications are reviewed individually by an authorised person.
Artoria aims to communicate the outcome of an application within a maximum of 72 hours after submission.
The outcome will normally be sent to the email address associated with the applicant’s Artoria account.
Where exceptional circumstances require additional verification, or where technical or operational circumstances outside our reasonable control arise, the review may take longer.
Artoria may approve or decline an application in accordance with applicable law.
No admission decision will be made on grounds on which discrimination is prohibited by applicable law.
5.4. Acceptance of a standard application
If an application is approved, the applicant will receive an email informing them of the decision and explaining how to proceed with membership activation.
Approval does not automatically result in a charge and does not itself activate paid membership.
The applicant must complete the applicable purchase process before membership becomes active.
5.5. Member invitations
Artoria may allow active members to invite other individuals to join Artoria Society.
Unless Artoria expressly provides otherwise for a particular membership, programme or period, an active member may issue up to three invitations during each 12-month period of active membership.
Invitations may be issued using a unique invitation code, invitation link or another mechanism provided by Artoria.
An invitation is intended for the person to whom it is issued and is subject to these Terms.
5.6. Admission through a member invitation
Where an eligible person uses a valid invitation issued by an active Artoria Society member, the usual manual Artoria application review may be bypassed.
The invited person may instead proceed directly to the membership acceptance and activation process.
The invited person may receive an email confirming the invitation and providing the information necessary to continue registration and purchase the membership.
A valid invitation:
- does not provide free membership;
- does not itself activate membership;
- does not result in an automatic charge;
- does not remove the requirement to satisfy mandatory eligibility requirements, including the minimum age requirement;
- does not remove the requirement to purchase and maintain an active membership.
Membership becomes active only after the required onboarding steps have been completed and payment has been successfully confirmed.
5.7. Invitation restrictions
Invitations may not be sold, offered for sale, exchanged for payment or other consideration, publicly distributed for commercial purposes or otherwise used in an abusive or unauthorised manner.
We may invalidate, suspend or refuse an invitation where we reasonably believe that:
- it has been obtained, sold or used fraudulently;
- the code or link has been publicly distributed contrary to its intended purpose;
- the invitation mechanism is being manipulated or abused;
- the invited person does not satisfy mandatory eligibility requirements;
- its use creates a security risk;
- its use otherwise breaches these Terms or applicable law.
Artoria may adjust the number, format or availability of future invitations.
Changes affecting invitations already validly issued will be handled reasonably and in accordance with applicable law.
Unused invitations have no monetary value and cannot be exchanged for cash, credit or any other financial benefit unless Artoria expressly states otherwise.
5.8. Purchase and activation of membership
Following approval of a standard application, or validation of an eligible member invitation, membership may be purchased through one or more methods made available by Artoria, including:
- a secure payment link sent to the email address associated with the account;
- Apple App Store;
- Google Play;
- another payment method made available by Artoria.
Before the user confirms a purchase, the relevant purchase interface will provide the material commercial information applicable to the transaction, which may include:
- the membership price;
- the applicable currency;
- the billing period or duration;
- whether the membership renews automatically;
- the applicable cancellation method;
- any material conditions applicable to the purchase.
Membership becomes active only after payment has been successfully confirmed and the relevant Artoria account has been updated accordingly.
5.9. Access to Artoria
Access to member-only Artoria functions, content and benefits requires an active membership.
A user whose application has been approved, or whose invitation has been validated, but who has not completed payment does not hold an active Artoria Society membership.
Where a membership expires, is cancelled, is not successfully renewed or otherwise ceases to be active, access to member-only features may be restricted or disabled.
5.10. Recurring memberships
Where a membership is offered as an automatically renewing subscription, it may renew at the end of each billing period until cancelled.
The applicable price, billing period and recurring nature of the subscription will be disclosed before purchase.
Cancellation stops future renewals in accordance with the rules applicable to the relevant payment method. Unless otherwise required by law or stated in the applicable purchase terms, cancelling a recurring subscription does not necessarily terminate access immediately and membership may remain active until the end of the already-paid billing period.
5.11. Membership purchased through Apple App Store
Where membership is purchased through the Apple App Store, payment processing and subscription billing are handled by Apple.
The user’s purchase may also be subject to Apple’s applicable terms and policies.
Subscription management, renewal, cancellation and refund requests for purchases processed by Apple are handled in accordance with Apple’s applicable systems, rules and mandatory consumer law.
Deleting the Artoria application does not by itself cancel an App Store subscription.
Where applicable, the user must cancel the subscription through the relevant Apple subscription management functionality.
5.12. Membership purchased through Google Play
Where membership is purchased through Google Play, payment processing and subscription billing are handled by Google.
The user’s purchase may also be subject to Google’s applicable terms and policies.
Subscription management, renewal, cancellation and refund requests for purchases processed through Google Play are handled in accordance with Google’s applicable systems, rules and mandatory consumer law.
Deleting the Artoria application does not by itself cancel a Google Play subscription.
Where applicable, the user must cancel the subscription through the relevant Google Play subscription management functionality.
5.13. Membership purchased through an external payment link
Where membership is purchased through a payment link provided by Artoria, payment may be processed by a specialised payment service provider.
The price, billing period, recurring nature of the payment, where applicable, and material purchase conditions will be presented before payment is confirmed.
Artoria may receive information required to confirm and administer the membership without receiving the complete payment card details used by the customer.
5.14. Consumer cancellation, withdrawal and refunds
Any mandatory cancellation, withdrawal, refund or other consumer rights available under applicable law remain unaffected by these Terms.
The existence and scope of a statutory right of withdrawal may depend on the nature of the digital service, the manner in which the contract was concluded, when performance begins and any consent or acknowledgement lawfully obtained from the consumer.
Where a purchase is processed by Apple App Store or Google Play, refund and cancellation requests may also need to be submitted using the procedures made available by the relevant platform.
Nothing in these Terms excludes a refund, remedy or other right that cannot lawfully be excluded.
5.15. Personal nature of membership
Artoria Society membership is personal to the holder of the approved account.
Membership may not be sold, assigned, transferred or shared with another person unless Artoria expressly permits this.
We may use a digital membership card, membership number, verification system or other reasonable mechanism to confirm membership status.
A membership credential must not be falsified, manipulated or knowingly provided to another person for unauthorised use.
5.16. Membership benefits
An active membership provides access to the Artoria Society functions, content and benefits made available for the relevant membership.
These may include:
- cultural and editorial content;
- art discovery and educational experiences;
- digital member features;
- access to the Artoria Society community;
- invitations or opportunities to attend selected events;
- access to member services;
- other experiences or benefits described within Artoria.
Certain events, products, services or experiences may:
- have limited capacity;
- require a separate reservation;
- have separate eligibility requirements;
- be provided by third parties;
- require an additional payment.
Holding an active Artoria Society membership does not guarantee admission to every event, experience or opportunity displayed through Artoria.
5.17. Expiry and cancellation of membership
Membership may end:
- at the end of the purchased membership period where it is not renewed;
- following cancellation of a recurring subscription;
- following unsuccessful payment or renewal;
- following account closure, subject to applicable payment and consumer rules;
- following a serious or repeated breach of these Terms;
- in cases involving fraud, abuse, unauthorised use or material security risks;
- where required or permitted by applicable law.
Any action taken by Artoria in relation to an active paid membership will be subject to mandatory consumer rights.
5.18. Account deletion does not necessarily cancel a subscription
Deleting an Artoria account or uninstalling the Artoria application is not necessarily the same as cancelling a recurring subscription.
In particular, subscriptions purchased through Apple App Store or Google Play may need to be cancelled separately through the relevant platform.
Users are responsible for following the applicable cancellation procedure if they wish to prevent future recurring charges.
This provision does not limit any obligation imposed on Artoria by applicable law.
6. Licence to Use Artoria
Subject to these Terms and, where applicable, an active membership, we grant you a limited, personal, revocable, non-exclusive and non-transferable right to use Artoria for personal, cultural and educational purposes.
This licence does not transfer any intellectual property right in Artoria or its content to you.
Using Artoria does not give you the right to commercially exploit the application, databases, editorial structure, design, original content or other protected material except where expressly permitted by law or authorised by us in writing.
7. Artoria Intellectual Property
To the extent protected by applicable law, Artoria and/or the relevant rights holders retain all rights in the original elements of the service, including:
- application code and structure;
- design and interface;
- visual identity;
- names, trademarks and branding elements;
- editorial structure and organisation;
- original texts and materials;
- educational and cultural materials;
- original quizzes and exercises;
- selections, classifications and database organisation;
- editorial and curatorial materials;
- the structure of original experiences or formats;
- membership materials and original Society features.
Nothing in these Terms transfers those rights to a user or member.
8. Prohibited Uses
You must not:
- access accounts, data or systems without authorisation;
- attempt to circumvent security mechanisms or technical restrictions;
- interfere with the normal operation of Artoria;
- use automated systems to extract content or data on a large scale without authorisation;
- systematically copy, reproduce, republish or redistribute Artoria content for commercial purposes;
- sell, sublicense or otherwise exploit the service without authorisation;
- attempt to obtain source code using methods not permitted by law;
- use Artoria for unlawful or fraudulent activity or activity that infringes the rights of another person;
- introduce malicious content or use Artoria to compromise the security of another system;
- impersonate another person or use another person’s account without permission;
- falsify membership status or membership credentials;
- abuse invitation, access or membership mechanisms;
- resell invitations or access to Artoria Society.
We may take reasonable and proportionate steps to protect Artoria where abusive, fraudulent or unauthorised activity is detected.
9. Art Content and Educational Nature
Artoria makes reasonable efforts to provide accurate and useful cultural and educational information.
Art history is, however, a field in which attributions, dates, interpretations, provenance information and identifications may be disputed, revised or changed following further research.
We therefore do not guarantee that every piece of information available through Artoria is complete, error-free or permanently up to date.
Artoria content is intended for informational, cultural and educational purposes.
It does not constitute professional advice relating to:
- authentication;
- valuation;
- conservation;
- restoration;
- investments;
- taxation;
- legal matters;
- provenance due diligence.
For decisions capable of producing significant financial, legal, patrimonial or professional consequences, users should consult appropriate official sources and, where necessary, a qualified professional.
10. Automated Identification and Other Automated Features
Certain Artoria features may use automated systems to identify or provide information about an artwork, artist, movement, period or other relevant characteristic.
Results generated by these features are indicative and informational.
They may be incomplete or incorrect and may confuse artworks, artists, dates, styles or contexts.
An automated Artoria result must not be used as the sole basis for:
- authenticating an artwork;
- establishing authorship;
- determining financial value;
- deciding whether to purchase or sell an artwork;
- entering into an insurance arrangement;
- establishing provenance;
- undertaking conservation or restoration;
- making a decision with significant legal or financial consequences.
Artoria is not an artwork authentication, appraisal or professional expert service.
11. Photographs and Materials Provided by Users
Where you choose to submit a photograph, image or other material using an Artoria feature, you remain responsible for having the right to use that material.
You must not knowingly submit:
- material for which you do not have the necessary rights;
- confidential information you are not entitled to disclose;
- personal documents where they are unnecessary for the relevant feature;
- unlawful material;
- material that infringes another person’s rights.
Submitting material does not transfer ownership of that material to Artoria.
You grant us only the rights reasonably necessary to technically process the material for the purpose of providing the feature you requested, in accordance with the Privacy Policy and applicable law.
To the extent permitted by law, Artoria is not responsible for third-party rights violations caused exclusively by material uploaded by a user without the necessary authorisation.
12. Images and Content from External Sources
Artoria may display images, metadata and other materials originating from sources including:
- the public domain;
- open-access collections;
- museums and cultural institutions;
- archives;
- external platforms;
- other third-party sources.
Rights in those materials remain subject to the legal conditions applicable to the relevant source and material.
The appearance of an image or other material within Artoria does not automatically give a user the right to reproduce, modify, distribute or commercially use it outside Artoria.
Users are responsible for verifying the applicable rights before making external use of third-party material.
If you are a rights holder and believe that material available through Artoria is being used improperly, you may contact us and we will review the request within a reasonable period.
13. Museums, Locations, Events and External Information
Artoria may provide information relating to museums, galleries, exhibitions, events, locations, opening hours, availability, access conditions or other matters based on external sources.
Such information may change without notice to Artoria.
Unless Artoria expressly undertakes otherwise, we do not guarantee the availability, opening hours, pricing, exhibition status, admission conditions, capacity or other conditions of a third-party venue, event or service.
Before travelling, making a purchase or making a reservation, users should verify material information directly with the relevant official source.
14. Third-Party Services and Websites
Artoria may integrate or provide access to services, maps, web pages, payment systems, images, ticketing resources or other services operated by third parties.
We do not control independent third-party services and do not guarantee:
- their availability;
- uninterrupted operation;
- the accuracy of independently provided information;
- the security of systems operated independently by the third party;
- their commercial terms;
- the manner in which they change or discontinue their services.
When you choose to interact directly with a third party, your relationship with that provider may also be governed by its own terms and privacy policies.
To the extent permitted by applicable law, Artoria is not responsible for independent acts or omissions of third parties over which it does not exercise control.
15. Service Availability
We aim to keep Artoria available and operational but cannot guarantee uninterrupted or error-free operation.
Artoria may be temporarily unavailable because of:
- maintenance;
- software updates;
- technical incidents;
- third-party provider incidents;
- security incidents;
- connectivity problems;
- circumstances outside our reasonable control.
We may make changes reasonably necessary for maintenance, security, development and compatibility.
Changes to digital services supplied to consumers will remain subject to any mandatory rights provided by applicable law.
16. Updates and Compatibility
Artoria may require updates to remain secure, compatible and functional.
Where reasonably necessary, users are responsible for maintaining a sufficiently up-to-date device, operating system and version of the Artoria application.
We cannot guarantee permanent compatibility with every device, operating system or software version.
Nothing in this section limits mandatory obligations relating to updates and conformity of digital services.
17. User Data and Progress
Certain information, such as membership status, progress, favourites, collections or preferences, may be associated with an Artoria account and synchronised through the service.
Other information may be stored only on the user’s device.
Information stored exclusively locally may be lost as a result of:
- uninstalling the application;
- resetting the device;
- deleting application data;
- changing devices;
- technical problems affecting local storage.
To the extent permitted by law, Artoria is not responsible for loss of information stored exclusively on the user’s device where Artoria did not offer a corresponding synchronisation or backup function.
18. Account Suspension or Closure
We may suspend, restrict or close an account where there are reasonable grounds to believe that:
- these Terms have been materially or repeatedly breached;
- Artoria is being used unlawfully or abusively;
- there is a material security risk;
- there is reasonable suspicion of fraud or unauthorised access;
- membership credentials or invitations are being abused;
- action is necessary to protect users, members or Artoria infrastructure;
- we are required to do so by law or by a binding request from a competent authority.
Where circumstances permit, measures will be proportionate to the relevant situation.
Where required by law, we will provide appropriate information concerning the action taken.
A user may stop using Artoria at any time and may request account deletion in accordance with the Privacy Policy.
Deleting the application from a device does not automatically delete an Artoria account, delete synchronised data or cancel a recurring subscription.
19. Prices and Changes to Membership Fees
The price applicable to a membership will be displayed before the user completes the purchase.
Artoria may change the price of future membership periods.
Where a price change affects an automatically renewing subscription, any notice, consent or other procedure required by applicable law or the relevant payment platform will be followed.
A price change will not retroactively alter an already completed purchase.
20. Limitation of Liability
Artoria remains liable to the extent required by applicable law.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.
To the extent permitted by law, Artoria is not responsible for losses arising from:
- use of the service for a purpose materially different from that for which it is intended;
- decisions made solely on the basis of cultural, educational or automatically generated information;
- errors or omissions originating from independent external sources;
- changes made independently by museums, galleries, event organisers or other third parties;
- temporary unavailability of independent third-party services;
- misuse of an account, invitation or membership credential by the user;
- material submitted by a user in violation of another person’s rights;
- incompatibility caused by devices or software that are no longer reasonably supported;
- events outside our reasonable control.
To the extent permitted by law, we are not liable for indirect losses or consequences that could not reasonably have been foreseen at the time the relevant contract was entered into.
Where Artoria is supplied for personal use, we are not responsible, to the extent permitted by law, for business or commercial losses resulting from using it for professional or commercial purposes outside its intended scope.
Nothing in this section affects mandatory consumer rights.
21. Digital Services and Consumer Rights
Where the relationship between Artoria and a user falls within applicable consumer and digital-services legislation, the user retains all mandatory rights provided by that legislation.
Depending on the circumstances, these may include rights relating to:
- supply of the digital service;
- conformity of the digital service with the contract and its description;
- remedies where the service does not conform;
- an appropriate price reduction where statutory requirements are satisfied;
- termination of the contract where the law provides such a remedy;
- certain modifications to a digital service supplied over a period of time.
In Romania, contracts for the supply of digital content and digital services are regulated, among other applicable legislation, by Government Emergency Ordinance no. 141/2021.
Nothing in these Terms is intended to waive or reduce mandatory rights granted to a consumer.
22. Changes to Artoria
We may develop, reorganise, replace, modify or discontinue features where reasonably justified by factors including:
- development of the service;
- improvement of the member experience;
- technical requirements;
- security requirements;
- legal or regulatory developments;
- changes to third-party services;
- reasonable operational requirements.
Where a modification to a digital service supplied over a period of time triggers mandatory consumer rights, those rights will be respected.
23. Changes to These Terms
We may update these Terms to reflect:
- changes in law;
- changes to Artoria or Artoria Society;
- new functionality;
- new membership mechanisms;
- security requirements;
- technical or operational changes.
The current version will display its latest update date.
Where required by law, or where a change materially affects a user’s rights, we will provide appropriate notice.
Where applicable law requires express agreement to a change, continued use of Artoria will not replace that required consent.
24. Discontinuation of Artoria
We may decide to discontinue Artoria or a material part of the service for reasonable commercial, technical, legal or operational reasons.
Where discontinuation affects rights arising from an existing paid consumer contract, we will comply with applicable mandatory obligations and remedies.
25. Force Majeure and Events Outside Our Control
To the extent permitted by law, we are not responsible for a delay or inability to perform an obligation where caused by events outside our reasonable control.
Such events may include major infrastructure failures, widespread network outages, large-scale cyber incidents, governmental actions, natural disasters or other events recognised as force majeure under applicable law.
26. Governing Law
These Terms are governed by Romanian law.
If you are a consumer habitually resident in another country whose law provides mandatory protections that apply to you, the choice of Romanian law does not deprive you of those mandatory protections.
27. Dispute Resolution
If an issue arises in connection with Artoria, we encourage you to contact us first so that we can attempt to resolve it amicably.
This does not restrict any right you may have to contact a competent consumer authority, data protection authority, alternative dispute resolution body or competent court.
28. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, it will be interpreted, limited or removed only to the extent necessary.
The remaining provisions will continue to apply to the extent permitted by law.
29. No Waiver
If we do not immediately exercise a right or enforce an obligation under these Terms, this does not by itself constitute a waiver of that right or obligation.
